Charged with DUI despite blood alcohol content of 0.000

Not entirely sure how you can blow a zero on the breathalizer, pass the drug and alcohol exam, and still get pinched for DUI.  Something fishy here.  Read at newsnet5.com:

Around 11 p.m. Thornton, according to Surprise Police Department paperwork, was pulled over for crossing the white line in his lane.

"He (the officer) walked up and he said 'I can tell you're driving DUI by looking in your eyes,'" said Thornton.

The 64-year-old says his eyes could have been red because he had just left LA Fitness where he was in the pool swimming.

"I take my glasses off and he says, 'You've got bloodshot eyes.' I said, 'I've been swimming at LA Fitness,' and he says, 'I think you're DUI,'" said Thornton. "He (the officer) goes, 'Well we're going to do a sobriety test.' I said, 'OK, but I got bad knees and a bad hip with surgery in two days.'"

Medical documents show Thornton was scheduled to have hip replacement surgery two days after the incident.

According to the police report, the officer notes that Thornton does have a hip and knee problem.

Thornton said two other officers arrived and he conducted the sobriety test.

A federal judge on Wednesday ordered HHS Secretary Kathleen Sebelius to allow 10-year-old Sarah Murnaghan to be moved to the adult lung transplant list, giving her a better chance of receiving a potentially life-saving transplant.

The quick and unusual ruling, made after a hastily scheduled emergency hearing, follows a campaign by the family and some members of Congress to pressure the Obama administration to change a federal policy that puts children under age 12 at the bottom of the list of those who can receive donated adult lungs.

Murnaghan has cystic fibrosis and her doctors have said she may only live a few weeks without the transplant. She has been on the waiting list for pediatric donors for 18 months, but they are more rare and her condition is worsening. There’s no guarantee that even with the judge’s ruling, a suitable donor will become available in time, but her odds would be better.

The case played out amid growing controversy with Sebelius in the spotlight. Several right-wing blogs and commentators depicted her as a one-woman “death panel.” The child’s mother said Sebelius was choosing to let children die.

Military Veteran stops a break-in attempt only to be arrested for protecting himself and his property

Obviously the heinous criminal is the one protecting himself.  Good job, Medford PD Rolling Eyes

Military veteran Corey Thompson, 36, told KDRV-TV that the wanted felon was trying to break into his home via the back door. Defending his property, Thompson said he warned the criminal that he was armed and he was giving him his one and only warning shot.

“This is the end result. You break into someone’s house, there’s consequences,” Thompson said.

Wielding his AR-15 semi-automatic rifle, the veteran made good on his threat and fired one warning shot. The bullet did not strike the suspect or anyone else.

“When I’m dealt with a stressful situation, being a veteran from Iraq and the Afghanistan war, it’s natural. I just jump into combat mode. I told him, ‘I’m going to give you a warning shot’,” Thompson explained.

However, police later determined he wasn’t justified in firing his weapon. Medford Police Lt. Mike Budreau said “there was nothing that the suspect was doing that was aggressive enough to justify the shooting.”

Apparently, for police in Medford, a wanted felon trying to break into a law-abiding citizen’s home isn’t enough to justify a warning shot.

Mother forced to pay spousal support to man convicted of raping her daughter

This is one of those laws that nullification or amendment is made for.  Astoundingly ridiculous.  Found at losangeles.cbslocal.com:

A mother who was forced to pay spousal support to the ex-husband who was convicted of raping her daughter is speaking out to CBS2.

“Every time I wrote that check, I cried because I felt like I was paying the man that raped my daughter,” Carol Abar told CBS2′s Andrea Fujii.

Carol married Ed Abar in 1991, when her daughter, who wishes to remain unidentified, was 9 years old.

When Carol found out about the abuse, she divorced Ed, but the legal system wasn't done with her yet.

Since Carol made more money than Abar, she was forced to pay alimony—$1,300 a month.

“The judge told me I had no proof. It was my word against him,” said Carol.

In all, Carol paid $22,000 to Abar until last year, when Abar struck a plea deal and pleaded guilty to one of the five rape charges. He was sentenced to more than a year in jail.

A judge then temporarily stopped the spousal support.

Now out of jail, Abar has filed to reinstate the support, according to Brian Uhl, Carol’s attorney.

“He’s asking not just to resume the existing support of $1,300 a month, but he’s asking for what amounts to approximately $33,000 in past due support and that too is a miscarriage of justice,” said Uhl.

Teen expelled and charged with a felony after a science experiment goes wrong.Unless there is direct evidence that it was an intentional action with an expected result, this is ridiculous.I totally agree that there are, and should be, consequences for the actions of an individual.  That being said, expulsion and arrest for popping the top off of a bottle is not right.
